The latest threat to the ACA

On September 5, 2018—the same day the Senate Judiciary Committee holds the first confirmation hearing of Brett Kavanaugh—Ken Paxton is leading another challenge to the constitutionality of the Affordable Care Act (ACA) in federal court. In this attempt to dismantle a law that has brought health insurance coverage to millions, however, the Department of Justice is refusing to defend crucial parts of the ACA—specifically, the law’s guarantee of coverage for those with preexisting conditions.

In light of the Trump Administration’s irresponsibility, the state of California stepped in to defend the law in court.

If Paxton is successful, over 52 million people across our country could be denied coverage—over 4.5 million in Texas alone.
